Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Thimble Travel ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms apply to all users of the App, including guest users and registered account holders.

2. Description of Service

Thimble Travel is an AI-powered travel planning application that helps users discover destinations and generate personalized trip itineraries through conversational AI. The App also lets you search for and book hotel accommodations through an integrated third-party booking provider. The App is provided by Arkhe Technologies Inc. ("we," "us," or "our"). Thimble Travel is a trade name operated by Arkhe Technologies Inc.

3. User Accounts

3.1 Guest Use. You may use limited features of the App without creating an account. Guest usage is subject to usage limits as described in-app and these Terms.

3.2 Eligibility and Registered Accounts. The App is intended for users who are 18 years of age or older. By creating an account or using the App, you represent and warrant that you are at least 18 years old. If you are under 18, you are not permitted to use the App.

To access full features, you may create an account by providing accurate information. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

3.3 Account Termination. We reserve the right to suspend or terminate accounts that violate these Terms. You may delete your account at any time from the Profile section of the App.

4. Subscriptions and Billing

4.1 Free Tier. Guest users and free registered users may generate a limited number of trips as specified within the App. These limits are subject to change.

4.2 Thimble Travel Premium. Thimble Travel Premium is a paid subscription that provides unlimited trip generation and additional features. Subscription pricing is displayed in-app at the time of purchase.

4.3 Billing. Subscriptions are billed through Apple App Store or Google Play Store, depending on your platform. Payments are charged at the start of each billing period. Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.

4.4 Subscription Refunds. This Section 4.4 applies to Thimble Travel Premium subscriptions only. Subscription refund requests are handled according to the policies of the Apple App Store or Google Play Store, as applicable, and we do not issue subscription refunds directly. Refunds for hotel bookings are governed separately by Section 6 (Hotel Bookings), not by this section.

4.5 Cancellation. You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time. This section concerns subscription cancellation; hotel booking cancellation is governed by Section 6.

5. AI-Generated Content

The App uses artificial intelligence to generate travel itineraries and recommendations. By using the AI features, you acknowledge and agree that: AI-generated content is for informational and planning purposes only and does not constitute professional travel advice; itinerary suggestions including activity availability, opening hours, prices, hotel availability and pricing, and venue existence may be inaccurate or out of date: you are responsible for independently verifying all travel information before making reservations or travel arrangements; we do not guarantee the accuracy, completeness, or fitness for purpose of any AI-generated content; travel conditions, visa requirements, health and safety conditions, and local regulations change frequently: always consult official sources and qualified professionals before traveling.

6. Hotel Bookings

This section governs hotel accommodations you search for and book through the App. It applies in addition to the rest of these Terms. If there is any conflict between this section and another section regarding hotel bookings, this section controls.

6.1 Our Role. Thimble Travel is an intermediary that lets you search hotel inventory and complete a booking through our integrated third-party booking provider. We are not the hotel, the accommodation supplier, or a travel agency. The contract for your stay is between you and the hotel or supplier that provides the accommodation. We do not own, operate, or control any hotel or its policies.

6.2 Eligibility to Book. You must be at least 18 years old and able to enter into a legally binding contract to make a booking. By booking, you confirm that the guest information you provide is accurate and that you are authorized to make the booking for all guests named. Individual hotels may impose a higher minimum age for the guest checking in (for example, 21 in some United States locations); you are responsible for meeting the hotel's minimum check-in age, and the hotel may refuse check-in if you do not.

6.3 Prices, Taxes, and Fees. Prices are shown at the time of booking and may change until a booking is confirmed. The price shown at checkout may not include all amounts payable for your stay. Certain charges, such as resort fees, city or tourist taxes, parking, incidentals, or deposits, may be collected directly by the property at check-in or check-out and are not part of the amount you pay through the App. You are responsible for any such property-collected charges. In the rare event of an obvious pricing error (for example, a rate that is clearly incorrect due to a technical or supplier error), we or the booking provider may correct the price, and you may choose to keep the booking at the corrected price or cancel it; we are not obliged to honor a clearly erroneous price.

6.4 Pay-Now Bookings. Hotel bookings made through the App are pay-now: payment is collected in full at the time you book. Pay-at-property is not offered.

6.5 Payment and Merchant of Record. Hotel payments are processed through the booking provider's hosted, secure payment form. Nuitée Travel Limited (which operates LiteAPI) acts as the merchant of record for your hotel booking. This means Nuitée Travel Limited processes the payment, is the party that charges your payment method, and handles the payment transaction for your hotel booking. Thimble Travel does not collect, receive, store, or process your payment card details, and Thimble Travel is not the party that charges you for the booking. Your card or payment statement will show the charge under "Nuitée Travel Limited" (or a similar descriptor), not "Thimble Travel." We note this so you recognize the charge, because an unrecognized descriptor is a common reason people dispute legitimate charges.

6.6 Booking Confirmation. Your booking is confirmed only when you receive a confirmation from us or the booking provider (for example, a confirmation screen and/or email). A booking is not guaranteed until confirmed. If a booking cannot be fulfilled, your sole remedy is a refund of amounts paid for that booking, handled by the merchant of record.

6.7 Cancellations and Refunds. Each hotel rate has its own cancellation policy. The applicable policy (including whether a rate is refundable or non-refundable, and any cancellation deadline) is shown to you in the App before you book and again in your booking confirmation. Some rates are non-refundable, and some have cancellation deadlines after which no refund is available. By booking a rate, you agree to that rate's cancellation policy. Cancellations should be made through the App or the booking provider; cancellations arranged directly with the hotel may not be recognized. Where a refund is due under the applicable rate policy, it is processed by the merchant of record (Nuitée Travel Limited), not by Thimble Travel. Thimble Travel does not independently issue, guarantee, or advance hotel refunds.

6.8 Changes and Amendments. Hotel bookings generally cannot be freely changed after they are confirmed. Depending on the rate and the hotel, changes to dates, room type, guest names, or occupancy may not be permitted, may be limited to a single amendment, or may require cancelling and re-booking at the rates available at that time, which may be higher. Any amendment is subject to the rate's terms and the hotel's and booking provider's policies. We are not able to guarantee that a requested change can be made.

6.9 Hotel Policies. Your stay is subject to the hotel's own policies, including check-in/check-out times, age and occupancy limits, identification and payment-card requirements at check-in, deposits, pet and smoking policies, and conduct rules. If you expect to arrive late (for example, after 9:00 p.m.), you are responsible for notifying the hotel, as the room may otherwise be released. We are not responsible for a hotel's enforcement of its policies, including denial of check-in where you do not meet the hotel's requirements.

6.10 Accuracy of Hotel Information. Hotel descriptions, photos, amenities, star ratings, maps, availability, and pricing are provided by suppliers and third parties and may be incomplete, inaccurate, or out of date. Star ratings and category classifications vary by country and are not a guarantee of standard. We do not warrant this information and are not liable for supplier-provided errors.

6.11 Overbooking and Relocation. In rare cases a hotel may be unable to honor a confirmed booking (for example, due to overbooking, closure, or maintenance). Where this happens, the hotel or supplier is responsible for providing alternative accommodation of a similar standard, and the booking provider's role is generally limited to assisting with one alternative. Thimble Travel does not control hotel availability and is not liable for losses or costs arising from overbooking or relocation.

6.12 Supplier Acts and Limitation. Thimble Travel is not liable for the acts, errors, omissions, representations, or service quality of any hotel, accommodation supplier, or the booking provider, including overbooking, closure, relocation, failure to honor a reservation, or illness, injury, loss, or damage arising during your stay. Your remedies for such events are against the hotel or supplier and, where applicable, the merchant of record under the relevant rate and payment terms.

6.13 Travel Insurance. We strongly recommend that you obtain your own travel insurance. Non-refundable bookings, cancellations made after a rate's deadline, trip interruptions, medical emergencies, and similar events are your responsibility and are not covered by Thimble Travel. Thimble Travel does not sell travel insurance and this recommendation is not insurance advice.

6.14 Subscriptions vs. Bookings. Hotel bookings are separate from any Thimble Travel Premium subscription. Hotel bookings are paid outside of Apple In-App Purchase and Google Play Billing (which are used only for subscriptions). Booking refunds are never processed through the App Store or Google Play; see Section 6.7.

7. Acceptable Use

You agree not to: use the App for any unlawful purpose or in violation of any applicable laws or regulations; attempt to circumvent usage limits, paywalls, or account restrictions through technical means; submit inputs to the AI chat designed to manipulate, jailbreak, or extract harmful content from the AI system; impersonate any person or entity or misrepresent your affiliation with any person or entity; make fraudulent or speculative bookings, or bookings you do not intend to honor; reverse engineer, decompile, or disassemble any portion of the App; use automated scripts, bots, or other means to access the App at scale.

8. User Content and License

8.1 Your Content. The App lets you create and store content, including chat messages with the AI, trip notes, favourites, and other inputs you provide ("User Content"). You retain ownership of your User Content.

8.2 License to Us. By submitting User Content through the App, you grant Arkhe Technologies Inc. a limited, worldwide, royalty-free, non-exclusive license to host, store, reproduce, and display your User Content solely as needed to operate, maintain, and provide the Service to you (for example, sending your chat messages to our AI processing provider, displaying your itineraries back to you across sessions, and storing your trip history). This license ends when you delete the relevant User Content or your account, except to the extent we are required to retain copies for legal purposes or in routine backups that are deleted on a normal cycle.

9. Intellectual Property

The App and its original content, features, and functionality are owned by Arkhe Technologies Inc. and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. Trip itineraries generated by the App are provided for your personal use. You retain the right to use your generated itineraries for personal travel.

10. Affiliate Disclosure

Some links in the App and on our website, including in the Travel Essentials section, are affiliate links. When you make a purchase through those links, Thimble Travel may receive a commission at no additional cost to you. Affiliate relationships do not influence our recommendations. Current affiliate partners include Saily, NordVPN, NordPass, and Wise. Hotel bookings are not affiliate links; our compensation on hotel bookings is described in Section 6 and the commission is built into the price you see.

11. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices, including how your information is handled when you make a hotel booking.

12. Third-Party Services

The App relies on third-party service providers to operate, including providers of AI processing, analytics, image content, subscription management, transactional email and notifications, sign-in, hosting and database services, and hotel search, booking, and payment processing. In particular, hotel bookings are processed by Nuitée Travel Limited (LiteAPI) as merchant of record. The specific providers we use are listed in our Privacy Policy and may change from time to time. Your use of the App is subject to the applicable terms of these third-party providers. We are not responsible for the practices of third-party services.

13. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE ARE NOT RESPONSIBLE FOR ANY HARM ARISING FROM YOUR TRAVEL DECISIONS BASED ON APP CONTENT, OR FROM THE ACTS, ERRORS, OMISSIONS, OR SERVICE QUALITY OF ANY HOTEL, ACCOMMODATION SUPPLIER, OR BOOKING PROVIDER.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARKHE TECHNOLOGIES INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) THE COMMISSION WE EARNED ON THE SPECIFIC HOTEL BOOKING GIVING RISE TO THE CLAIM. AMOUNTS YOU PAID FOR A HOTEL STAY ARE NOT "AMOUNTS PAID TO US" FOR THIS PURPOSE, AS THOSE PAYMENTS ARE PROCESSED BY THE MERCHANT OF RECORD.

15. Changes to Terms

We may update these Terms at any time. If we make material changes, we will notify you through the App or via email before the changes take effect, and we will update the Effective Date above. Continued use of the App after the updated Effective Date constitutes acceptance of the updated Terms.

16. Governing Law and Venue

These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict of law provisions. You agree that any dispute arising out of or relating to these Terms or the App shall be brought exclusively in the courts located in the Province of Alberta, Canada, and you consent to the personal jurisdiction of those courts.
